4. Behavior Based Systems - In and Past Custody History

Behavior based systems are also known as the “just deserts” model. This model works off how the inmate is doing in our facility at this time. The following “weight chart” gives a probability estimate to future conduct.

  • Past Behavior is 70% reliable (criminal & institutional history)

  • Current Behavior is 80% reliable (first 30 to 60 days of custody)

  • Long Term custodial behavior is 90% reliable (60 to 90 days)

  • Even under the best of control conditions, there will always be a 10% error factor (the human condition)


Stability In Population is most important. If the inmate is “getting along” with others in their housing unit, more or less privileges are granted.

Protection/Control Issues can be an issue. The inmate may feign a behavior, good or bad, for the purposes of being placed in a predictable unit or housing area. Example, disruptive persons automatically go to Medium Maximum. This is where the inmate wants to go to be with friends or enemies.

Need for Special Services such as medical or psychiatric can present issues if certain behaviors automatically have a fixed outcome. A reverse manipulation of this model is a psychiatric inmate who deliberately stops and alters their medication regime in order to gain a predictable outcome.
